A diagnosis of HIV alone is not enough for a Social Security disability approval. Many people are under the misconception that a diagnosis of HIV is an automatic approval for Social Security disability benefits. An applicant who has been diagnosed with HIV must show that they comply with medical treatment and yet have severe enough symptoms to keep them from working a full-time job.

With advances in the medical treatment of HIV, many people can work for a long time after their diagnosis and live relatively normal lives. However, there are cases in which HIV progresses to AIDS and can be disabling. If HIV develops into AIDS the claimant may have severe enough symptoms to qualify for Social Security disability.

A claimant must prove to Social Security that they either

  • meet a listing for HIV/AIDS (for instance, that they have recurrent infections such as pneumonia), or
  • that their symptoms are severe enough to keep them from working on a regular and continuing basis.

Under Social Security’s current regulations, the CD4 count is not as important as it used to be. If you have a low CD4 count it likely means you have severe symptoms from HIV/AIDS. The test results are not as important as the symptoms. The symptoms of HIV/AIDS are what can be disabling, and the symptoms are what Social Security is most concerned with when making a decision.
